These Terms of Service (“Terms”) govern your access to and use of nestandroad.com and any related products, content, features, and services provided by Nest & Road (collectively, the “Services”). By visiting, browsing, or purchasing through the Services, you agree to these Terms and the policies referenced in them.

Eligibility and lawful use

You must be at least the age of majority in your jurisdiction or have permission from a parent or legal guardian. You may use the Services only for lawful purposes and in compliance with these Terms.

Store information and accounts

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly of suspected unauthorized use.

Products and descriptions

We make reasonable efforts to display product descriptions, measurements, colors, images, availability, and other information accurately. Screen settings, manufacturing changes, and reasonable product variations may affect appearance. We may correct errors, update information, or discontinue products without prior notice.

Prices and payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and other fees are displayed before order completion when required. Prices and promotions may change, but changes do not affect an order already accepted except to correct an obvious error as permitted by law.

You represent that you are authorized to use the payment method submitted. Orders are subject to payment authorization, fraud review, and acceptance.

Orders

An order confirmation acknowledges receipt of your order and does not necessarily constitute final acceptance. We may limit quantities or cancel an order for reasons including payment failure, suspected fraud, pricing or inventory error, shipping restriction, or product unavailability. If we cancel a paid order, we will refund the affected amount to the original payment method.

Shipping, returns, and refunds

Shipping is governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy. Those policies form part of these Terms.

Reviews and submitted content

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant Nest & Road a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the Services, subject to applicable law and our Privacy Policy.

Prohibited conduct

You must not misuse the Services, violate law, infringe intellectual-property or privacy rights, submit malicious code, interfere with security, scrape or automate access without authorization, impersonate another person, submit false information, or use the Services for fraudulent, abusive, or harmful activity.

Third-party services and links

Shopify and other third parties provide parts of the Services, including hosting, payment, fulfillment, shipping, analytics, and optional links or integrations. We are not responsible for third-party websites or services that we do not control. Your use of them may be governed by separate terms and privacy policies.

Intellectual property

The Services and their original text, graphics, design, branding, logos, and other content are owned by or licensed to Nest & Road and are protected by applicable intellectual-property laws. No license is granted except the limited right to use the Services for personal, lawful shopping purposes.

Disclaimers

To the maximum extent permitted by law, the Services and products are provided on an “as available” basis. We do not warrant that the Services will always be uninterrupted, secure, or error-free. Product warranties, if any, are limited to those expressly stated by Nest & Road or the manufacturer. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, Nest & Road and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from use of the Services or products. Where liability cannot be excluded, it is limited to the amount paid for the product or transaction giving rise to the claim, except where applicable law requires otherwise.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Nest & Road harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.

Severability and waiver

If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.

Termination

We may suspend or terminate access to the Services for a material violation of these Terms, suspected fraud, security risk, or unlawful conduct. Obligations that by their nature should survive termination will remain in effect.

Governing law

These Terms are governed by the laws applicable where Nest & Road is established, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply.

Changes to these Terms

We may update these Terms by posting the revised version on this page and changing the “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
